This Agreement contains the complete terms and conditions that apply when you visit our site, use, or choose to browse the contents herein. By using AllLinks88.com, you agree to be bound by its terms of use and shall comply thereof. This Agreement describes and encompasses the entire agreement between us (‘All Links’) and you (‘You’ or ‘Customer’), and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site and the content provided by or through the Site, and the subject matter of this Agreement.

Order Cancellations

Orders that are cancelled are subject to a cancellation fee based on the current production status of your job. The fees are as follows:

• $10.00 – PRIOR to a proof being sent for printing.
• $25.00 – AFTER a proof being sent, but PRIOR to print job approval.
• NO REFUND – There will be no refunds of any kind AFTER a job has been approved for printing.

ALL REFUNDS WILL BE IN THE FORM OF IN-HOUSE CREDIT

Proofs

Once artwork has been submitted, an online proof will be sent to your e-mail. Print jobs will only begin AFTER final proof approval. We will not be responsible for any and all errors in the customer’s printing job after final artwork has been approved. Final approval will only be accepted in written format.

Please note that although online proofs supplied to the customer are highly calibrated and very accurate, they cannot match the final printed product 100%. Note that the customer proof may not closely match our proofs or the printed piece either for the same reasons, and because the customer supplied proofs are not calibrated to our presses.

We do not offer or send physical proofs. Only online proofs will be sent via e-mail.

General Information (For Printing)

Preferred file type is Adobe PDF. Acceptable applications include (but not limited to) Adobe Illustrator, Adobe Photoshop, Adobe Fireworks, and Adobe PDF. We cannot guarantee consistent results if files are generated by other applications like Microsoft Publisher or do not meet our resolution requirements. For best results, all rasterized files should be converted to CYMK. All fonts must be included or embedded. Prices subject to change without notice. All jobs require payment in full upon acceptance of order . Unless other payment terms have been previously arranged and account is up to date, your credit card will be charged upon placement of order.

Right of Refusal

We reserve the right to refuse service or products to any person or organization.

Privacy Policy

All Links’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that All Links can use such data in accordance with our privacy policies.

Electronic Communications

When you use any of our Services, or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Your All Links Account

You may need an All Links Account in order to use some of our Services. You may create your own All Links Account, or your All Links Account may be assigned to you by an All Links sales associate/employee.

If you use any All Links, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. All Links does not sell products to children. If you are under 18, you may use our Services only with involvement of a parent or guardian. All Links reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Risk of Loss

All items purchased from All Links are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Production Descriptions

All Links attempts to be as accurate as possible. However, All Links does not warrant that product descriptions or other content of our Services are accurate, complete, reliable, current, or error-free. We reserve the right to modify the contents of this site at any time without obligation on our end to update any information on the site. You understand and agree that it is your responsibility to monitor changes to the site.

License and Site Access

All Links grants you a limited license to access and make personal use of this site and not to download or modify it, or any portion of it, except with express written consent from our company. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent from our company.

In the event that any provision of these Terms and Conditions is found invalid or unenforceable pursuant to any judicial decree or decision, such provision shall be deemed to apply only to the maximum extent permitted by law, and the remainder of these Terms and Conditions shall remain valid and enforceable according to its terms.

About These Terms

We may edit, delete or modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion. YOUR CONTINUED VISIT IN OUR WEBSITE WILL CONSTITUTE BINDING ACCEPTANCE OF THE CHANGE.

This Agreement shall be governed by and construed in accordance with the substantive laws of California, without any reference to conflict-of-laws principles. The Agreement describes and encompasses the entire agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the contents and materials provided by or through the Site, and the subject matter of this Agreement.

Governing Law

Any dispute, controversy or difference which may arise between the parties out of, in relation to or in connection with this Agreement is hereby irrevocably submitted to the exclusive jurisdiction of the courts of California, to the exclusion of any other courts without giving effect to its conflict of laws provisions or your actual state or country of residence.

All Links Layout Services

Please read All Links terms and conditions carefully. By using our website or any of our services, you (the “Customer”) agree to be bound by the terms and conditions listed below.

Layout Approval

When you (the “Customer”) approves a layout, you agree to the following terms & conditions:

• YOU (the “Customer”) are responsible to verify that the spelling is correct.
• YOU are responsible to verify that the grammar/punctuations is correct.
• YOU are responsible to verify that all the content is complete and accurate.
• YOU are responsible to verify that the document has been set up properly with correct finished product size.
• YOU understand that the online proof represents an approximation of the layout and text, but not the true reflection of the color that will be printed in the final product.
• YOU understand that any graphics (if any) being used in the your layout is not checked for resolution. We will be using the graphics you provided as-is. We do not and cannot adjust image resolution for customer-provided graphics.
• YOU understand that there will be shifts during the print production process. Trim lines are estimates of where the machines will cut. They are not guaranteed to cut exactly where indicated. Shifting also occurs for special services such as: foiling, embossing and Spot UV coating.
• WE (“All Links”) do not guarantee the accuracy of our printing reproductions, especially when it comes to trimming and color.
• WE (“All Links”) do not guarantee turnaround times.
• YOU understand that under no circumstance will a reprint or refund be honored for color variations, spelling/grammar errors, missing text, or low resolution images in the final print.

Layout Process

When you place a print order with us you have the option of choosing a layout package that best corresponds to your layout needs. After you check out, you will be contacted by our graphic artist to go over content and discuss layout criteria. We reserve the right to adjust the final layout price according to your actual provided content, graphic requests, and/or number of revisions you request. You will need to pay any outstanding layout or printing balance before your order can be processed.

Revisions

For each layout package you are given a set number of revisions you can make. These revisions are for small edits, such as change of color, edit text, or change fonts…etc. They cannot be used to make a new layout design. If you wish to see a redesign or new layout of your content, you will be charged an additional new layout fee.

If you have used up the number of revisions you were given and wish to make additional edits to your layout, an additional revision fee will apply per revision. Revision fees will vary according to the amount of time and effort the graphic designer needs to spend to make the revision(s).

Once you have approved a layout for print, it will be shortly processed to print. You can NO LONGER make any changes or revisions. You will be responsible for any errors, inaccuracies, and/or missing content in the final printed product.

Layout Cancellations

Once our layout process has started*, you will be responsible for the layout price (full amount or portion of). All layout pricing is final and non-refundable

* The layout process is considered initiated when a graphic artist contacts you (either via email or phone) to go over your content and discuss layout criteria.

• You may cancel layout services and receive a FULL LAYOUT FEE REFUND if no graphic artist has contacted you and no layout work has begun.
• If you wish to cancel layout services that has been completed but not yet approved for print, you will be responsible for the FULL LAYOUT PRICE.
• If you wish to cancel layout services that has begun (graphic artist has gone over your layout content with you) but no work has been started, you will be responsible for $10 FLAT FEE.
• If you wish to cancel layout services that has begun but not fully completed yet, you will be responsible for $10 FLAT FEE + percentage (%) of design completed.

To cancel layout services, you must request the cancellation via email (sales@alllinks88.com), followed by a phone call (626-234-8028).

Layout Files

To lower the layout cost for our customers, we do not include any file processing fees in our layout price. The layout fee that you pay is for labor only. Under completion of the layout, you will receive a FREE electronic proof of your layout. If you wish to receive a high resolution, print-ready electronic copy (JPG/PDF) of the layout, it will be an additional +$10.00/file processing fee. We do not give out any editable files.

Exclusive Rights

All layouts or designs created by All Links graphic designers do not come with exclusivity. They may or may not be used for future layouts, website and/or promotional activities.

Access to Content

We (“All Links”), do not store or archive any of your electronic and/or media submissions. As such, we strongly recommend you back up a copy of your original files. It is your responsibility to maintain a copy of your files, not ours. We will not be able to send back any of your files/content at any given time.

Customer-Provided Content

You are solely responsible for the content of any materials (including, without limitation, any image or content being reproduced as part of your order), including, without limitation, creative suggestions, submissions, artwork, logos, service marks, trademarks, images, text, ideas, notes, drawings, photographs, graphics, messages, concepts, or other information or communications you send, upload, post or transmit to us via this website, the Internet, e-mail, or otherwise.

All Links is not liable for any damages resulting from violation of copyright laws, misappropriate or illegal use of intellectual property or other proprietary rights provided by the customer to All Links. You (the Customer) are the owner of or have the right to license any graphics and/or content you send to us.

You acknowledge that All Links does not pre-screen any submitted graphics or content. All Links shall have the right (but not the obligation) in their sole discretion to remove any content that violates these Terms of Use or may otherwise be objectionable. You further acknowledge and agree that All Links may preserve your content and may also disclose your content if required to do so by law or if there is certain belief that such preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) enforce these Terms of Use; (iii) respond to claims that the content violates the rights of third-parties; or (iv) protect the rights, property, or personal safety of All Links, its users and the public.
